Copyright AgreementPlease read and agree to the following Copyright Agreement. Copyright Agreement for SNIA TutorialsThis Copyright Agreement ("Agreement") is entered into by and between the individual or entity indicated below ("Author") and the Storage Networking Industry Association, with offices located at 425 Market Street, Suite 1020, San Francisco, CA 94111 ("SNIA"). Now therefore, for good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, Author does hereby agree as follows:
In order to enable SNIA to use the Tutorial in the manner it deems best, I hereby release and discharge SNIA, including without limitation its Board of Directors, officers, and employees, from any claims that I may have against it by use of the Tutorial, except for acts of willful misconduct or gross negligence. Author will identify all material (including without limitation text, forms, tables, illustrations, artwork, or photographs) in the Tutorial for which the copyright or other intellectual property right is owned or claimed by anyone other than the Author, and will obtain and provide to SNIA written permission to use the work in a manner consistent with this Agreement, except to the extent that the pre-existing material comes from prior SNIA Tutorials, or disclose any limitations on such use to SNIA. If the Author is unable to obtain the necessary permissions, or SNIA is unwilling to comply with the imposed limitations on use, Author will remove the third-party material from the Tutorial. Except to the extent that there is disclosed pre-existing material, Author warrants and represents that to the best of Author's knowledge, Author is the sole (joint if multiple Authors are listed above) author of the Work; that the Tutorial does not infringe the copyright or property right of another; that the Tutorial does not contain matter that is defamatory, violates another's civil rights, rights of privacy, rights of publicity, or other legal rights; and that Author has full power to convey the rights granted in this Agreement. The validity, construction, and performance of this Agreement shall be governed by the laws of the United States without regard to principles of conflict of law. Any dispute arising from or in connection with this agreement shall be subject to the exclusive jurisdiction of the state or federal courts of California, and both parties consent to exclusive jurisdiction in such court. |
